I’m writing to ask for your assistance once again with my divorce case. I know that you are not an international divorce lawyer but I also know that you have done the odd divorce case for clients and I feel that your legal intelligence and INTEGRITY (which is very important) is sufficient to put forward a new application to the divorce courts of France on my behalf; and we both know that your competent enough to follow the procedure relevant to article 242 of the Civil Code – N .121 – Divorce pour faute. I’m asking you for the second time because this is the only hope I have to move forward.
During a previous discussion you wanted to refer me to a female friend (of yours) who may be willing to help, however, I don’t want a female lawyer on this case and I have my reasons.
Ideally I’d like to represent myself but the European Divorce Courts (both Malta and France), will only allow me to do that during mediation, which had proven to be a waste of time – tried and failed in 2014 on the first attempt; mediation never actually took place.
In 2020; it’s been six years since ceasing co-habitation with my husband because of his violence and I’m still homeless because he refused the initial demand from the first lawyer to continue my living standards; which is a breach of the 72FLA, applicable to Maltese Law.
From the position of homelessness, I couldn’t contend with my husband’s new place of work, the Ministry of Social Solidarity, which carried weight in a system of who you know and the situation has deteriorated ever since.
In FRANCE 2017; I already have two passports and can not get a third (for France), which means I can not apply for financial assistance from the French Government to fund the very basics, clothing, three meals every day and a roof over my head. I have a no hope of getting a job because (a) no one wants to hire a homeless person because of a stigma that comes with that label and (b) I can not work and pay taxes from the tent that I sleep in, because it’s not an official residential address and everyone is required to pay employment tax and even if there was some loop hole to the law, I still need to shower and present clean, even just for the odd kitchen job.
There are other factors that effectively obstruct my employment opportunities but these are the main ones.
In response, I have spent the past twelve months pursuing a permit to sell art work on the streets of Paris, legally, however the Marie de Paris in the 12 district who issue such permits (micro-entrepreneur) have only granted it for two days last August; and has since refused the opportunity for an extension. The Prefecture of Police, can certainly authorise such a permit, however, the head office open to the public near Notre Dame, require a demand from the local police station in the 1st district, who have so far not responded to my request for such a demand.
Here in Paris, as a homeless person, there is no other opportunity that I am aware of, to earn an income through the correct channels, compliant with the law.
During discussions with legal aid funded lawyers for the purpose of proceeding with my divorce case (or even to start it, which has not yet happened), I have been informed that they will only apply for a straight divorce and not for compensation to restore my living standards; and via legal aid funds, I can not choose my lawyer.
Their reasons being that ‘this is a very complicated international divorce case and legal aid funds are insufficient for full representation of this case (which among other things include translation, evidence handling and international communication…).
Should you consider my request, I ask you NOT to UNDER ANY CIRCUMSTANCES communicate with my husband’s lawyer regarding this case, that ALL COMMUNICATION AND DOCUMENTS are submitted directly to the divorce courts and that if my husband’s lawyer has something to say, she can tell it directly to the judge (given her reputation of aggressive representation). I understand that lawyer have a privilege to communicate in confidence with each other but I also understand that I can, as a client, request that NO COMMUNICATION takes place; and that is my instruction.
Without your support, I’m stuck on the streets, so if you could kindly consider your services on legal aid assistance to help me move matters forwards via the divorce courts, I would greatly appreciate it. The end result is in GOD’S hands but someone has to open the door, I was hoping that person would be you.
